What are the different types of India work visa?
The India work visa for foreigners who are working as employees or doing paid internships in an Indian company is known as the Employment Visa or “E Visa”. This visa is also granted to individuals who travel to work with an NGO. Dependents are granted an Entry visa.
Eligibility Criteria for an E Visa
The following foreign nationals are eligible for the India work visa:
- Those who will work as regular salaried employees in a corporation, or who will otherwise undertake work for a company that carries out regular business in India.
- Those who have been invited to India as a consultant or on a contract by their employer.
- Those who travel to India to carry out certain business projects.
- Technicians, engineers, or SMEs who come to India to inspect, install, repair, or maintain any special equipment and machinery or provide specialized technical support, know-how, or who train workforces and are paid by an Indian company.
- Senior management and specialist personnel who are required to relocate to the country to carry out specific project-related duties or provide management expertise.
- Artists who are commissioned to perform regularly at hotels, clubs, etc.
- Sportspersons and coaches who are signed to play in or train national or state teams or sports clubs registered under an accredited sports authority.
- Foreign language teachers, trainers, and interpreters.
- Those who are professional chefs.
- Self-employed individuals who are SMEs in fields like engineering, medicine, law, etc. who travel to India to provide consulting services.
Other Conditions for E Visa Approval
Apart from fulfilling the above eligibility criteria, certain other essential conditions must be met for getting the India work visa approved. These include:
- There should not be any eligible and qualified Indian who is available for the role for which the E Visa is requested.
- The role must require a highly skilled individual with qualifications that cannot be easily replaced by an Indian. As such, clerical, secretarial, or other regular roles cannot be granted an E Visa.
- The employer must be a registered Indian organization or a foreign company that is executing business in India.
- The salary under an E Visa has to be more than $25,000 per year (chefs, interpreters, foreign language teachers, and staffers at a High Commission or Embassy in India are excluded).
- People on a visa should abide by all the taxation rules and regulations in place.
- The name of the visa sponsor and other details have to be mentioned clearly on the visa sticker during the application.
- All documents related to salary and employment must be in order and accepted by the Consulate or Embassy before the visa is granted.
Validity, Duration, and Extension of E Visas
The E Visa is usually given for one year initially by the relevant Embassy or Consulate. This is notwithstanding the duration of the employment contract given to the foreign national. Further extensions after the initial one year period are granted by the Ministry of Home Affairs (MHA) in the relevant Indian state. These extensions can be granted for a period of up to five years from the date of the initial visa issue.
Such extensions are subject to the good conduct of the visa-holder and production of the necessary employment and income tax documents. Usually, these extensions of visa validity are provided on an annual basis.
For foreign nationals with an E Visa that is valid for more than 180 days, it is mandatory to visit the nearest MHA within 14 days of arrival in the country to register themselves. The MHA will issue a Residential Permit to the visa holder in this case.
